Terms of Service

These Terms of Service ("Terms") govern your use of the BetterBooker platform ("Service") operated by BetterBooker ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
BetterBooker is a software-as-a-service (SaaS) platform that provides appointment booking and job management tools for tradesmen and service businesses. The Service includes online booking pages, calendar management, customer management, SMS and email notifications, and related features.
2. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account
You must be at least 18 years old to create an account. Each account is associated with a single business ("tenant").
3. Acceptable Use
You agree not to use the Service to:
- Send unsolicited or spam messages via SMS or email
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorised access to the Service or other users' data
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Resell, sublicence, or redistribute the Service without our written consent
- Interfere with or disrupt the integrity or performance of the Service
4. Data Processing & Your Responsibilities
When you use BetterBooker to manage appointments and customer data:
- You are the data controller for your customers' personal data
- BetterBooker acts as a data processor on your behalf
- You are responsible for obtaining appropriate consent from your customers before collecting and processing their personal data through the Service
- You must ensure your use of customer data complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018
5. SMS & Email Messaging
The Service integrates with third-party providers (including ClickSend) to send SMS and email notifications to your customers. You agree that:
- You have obtained consent from recipients before sending messages
- Messages sent via the Service comply with the Privacy and Electronic Communications Regulations 2003 (PECR)
- SMS credits are consumed on a per-message basis and are non-refundable once used
- We are not liable for message delivery failures caused by third-party providers or network issues
6. Payments & Billing
Certain features of the Service may require payment. Payments are processed securely via Stripe. By making a payment, you agree to Stripe's terms of service. All amounts are in GBP unless otherwise stated. We reserve the right to change our pricing with reasonable notice.
7. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by BetterBooker and protected by intellectual property laws. You retain ownership of any data you upload to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service to you.
8. Availability & Support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will make reasonable efforts to provide advance notice of planned downtime.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for any loss of business, revenue, or data arising from Service outages or errors
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms or for any other reasonable cause with notice. Upon termination:
- Your access to the Service will cease
- You may request an export of your data within 30 days
- We will delete your data in accordance with our Privacy Policy
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
